Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of bigpixel.pl and The Big Pixel platform (the "Service"). The Service is operated by Bigpixel Maciej Nowakowski, NIP 659 153 01 34("we", "us", or "our"). By creating an account, joining the waitlist, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

The Big Pixel is a cloud batch image studio. Depending on availability and your plan, you may upload image collections, run processing pipelines (including resize, creative filters, grayscale, and export formats such as JPEG, PNG, WebP, AVIF, and TIFF), store originals and variants in the cloud, and download results (including as a ZIP). Some features may be marked as coming soon and are not part of the current paid or free offering until we make them generally available.

3. Eligibility & Access

You must be at least 16 years old to use the Service. Registration may be limited or invite-only (for example via a waitlist). By registering or requesting access, you represent that you meet the age requirement and that the information you provide is accurate and complete.

4. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at support@bigpixel.pl if you suspect unauthorized access.

5. Acceptable Use

You agree not to:

  • Upload content you do not have the right to use or distribute
  • Upload unlawful, harmful, or infringing material
  • Attempt to disrupt, reverse engineer, or overload the Service
  • Circumvent plan limits, quotas, or access controls
  • Use the Service to harass, defraud, or harm others
  • Resell or sublicense access without our written permission

6. Your Content

You retain ownership of images and other materials you upload ("Your Content"). You grant us a limited license to store, process, display, transform, and transmit Your Content solely to provide the Service (including pipeline processing, cloud storage, and download/export). You represent that you have all rights necessary to grant this license.

7. Plans, Quotas & Payments

The Service offers a Free plan and a paid Pro plan. Limits (including cloud storage and pipeline credits) are described on the pricing page and may change with reasonable notice. As of the date above, illustrative limits are: Free — 1 GB storage and 25 pipeline credits; Pro — 1 TB storage and 1,000 pipeline credits. A pipeline credit is counted as each processing step applied to each image in a run (assets × steps).

Pro is offered as a one-time purchase (currently 30 zł unless otherwise stated at checkout), not a subscription, unless we clearly present a different offer. Payments are processed by Stripe. Purchase of Pro grants the plan entitlements associated with your account subject to these Terms and applicable quotas. We are not liable for loss of data caused by your failure to maintain backups outside the Service.

8. Intellectual Property

The Service, including its software, design, branding, and documentation, is owned by us or our licensors. These Terms do not grant you any rights to our trademarks or proprietary technology except as needed to use the Service.

9. Disclaimers

The Service is provided "as is" and "as available". We do not warrant uninterrupted or error-free operation. Automated image processing may produce unexpected results; you are responsible for reviewing outputs before use.

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us for Pro in the twelve months preceding the claim, or PLN 100 if you use only the Free plan.

11. Termination

You may close your account at any time by contacting us. We may suspend or terminate access if you violate these Terms or if required by law. Upon termination, your right to use the Service ends, and we may delete Your Content after a reasonable retention period.

12. Governing Law

These Terms are governed by the laws of Poland. Disputes shall be subject to the exclusive jurisdiction of the courts of Poland, without prejudice to mandatory consumer rights under applicable EU law.

13. Changes

We may update these Terms from time to time. Material changes will be communicated via the Service or email. Continued use after changes take effect constitutes acceptance of the updated Terms.
